TUREM Subscription & Trial Terms

These Subscription & Trial Terms govern access to subscription-based features, introductory offers, free trials and subscription-dependent Sound Banks made available through the TUREM application.

They apply to:

• the current FREE access level;
• PRO subscriptions;
• PRO+ subscriptions;
• introductory free trials;
• subscription upgrades, downgrades and cross-grades;
• Sound Banks included with a subscription;
• separately purchased Sound Banks that require an active compatible subscription;
• restoration and recognition of eligible purchases.

These terms supplement the TUREM Terms of Use, Privacy Policy, Sound Bank License and any terms presented by Apple during a transaction.

TUREM subscriptions and in-app purchases are offered through the Apple App Store.

Apple administers:

• payment processing;
• billing;
• applicable currency;
• taxes collected through the App Store;
• subscription renewal;
• Apple Account authentication;
• purchase history;
• introductory-offer eligibility;
• transaction confirmation;
• certain refund and billing procedures.

The price, currency, billing period, introductory offer, applicable taxes and transaction terms shown by the App Store before confirmation prevail over general information shown elsewhere.

StoreKit supports auto-renewable subscriptions and enables users to manage subscription access through Apple’s systems.

Purchases and subscriptions are associated with the Apple Account used to complete the transaction, subject to Apple’s systems and policies.

Users are responsible for:

• maintaining access to their Apple Account;
• reviewing the transaction before confirming it;
• managing their subscription through Apple;
• using the correct Apple Account when attempting to restore purchases.

TUREM does not control Apple Account credentials and cannot change the Apple Account associated with an App Store transaction.

TUREM currently offers a limited access level identified as FREE.

FREE does not currently require a paid subscription.

Its available features, limits, content and eligibility may change in future versions.

TUREM may:

• modify the features included in FREE;
• modify usage limits;
• add or remove free content;
• introduce different eligibility conditions;
• replace or discontinue the FREE level.

Any such change will be made subject to applicable law and will not remove rights that users have already acquired through valid purchases.

FREE must not be interpreted as a contractual promise that the same features or access conditions will remain available indefinitely.

PRO is a paid, auto-renewable subscription level.

PRO may be available through:

• a monthly subscription;
• an annual subscription.

An active PRO subscription grants access to the PRO features made available in the current version of TUREM.

The exact feature set may evolve as the application develops. Material changes will be communicated where required by applicable law.

PRO does not automatically include every Sound Bank distributed through TUREM.

Some Sound Banks may be:

• available free of charge;
• included only with PRO+;
• sold separately;
• subject to additional licensing or access requirements.

PRO+ is a paid subscription level separate from standard PRO.

While active, PRO+ may provide:

• the features available with PRO;
• access to a broader catalogue of eligible Sound Banks;
• access to additional content or functionality identified in the application;
• other benefits displayed before subscription confirmation.

Most paid Sound Banks may be included as part of the active PRO+ catalogue.

PRO+ does not necessarily include:

• every Sound Bank ever released;
• separately sold special collections;
• third-party or artist content subject to a specific licence;
• content expressly excluded from the PRO+ catalogue.

The App Store and the TUREM purchase interface will show the PRO+ durations that are currently available.

Before subscribing, the user will be shown the relevant information available through TUREM and the App Store, which may include:

• subscription name;
• included access level;
• billing period;
• current price;
• currency;
• introductory-offer availability;
• trial duration;
• renewal conditions;
• cancellation information.

The user should review the Apple purchase sheet before confirming the transaction.

TUREM may offer an introductory free trial lasting 14 days with an eligible auto-renewable subscription.

The trial is available only when:

• the offer is active;
• the selected subscription is eligible;
• Apple determines that the Apple Account qualifies for the introductory offer.

TUREM does not independently determine or override Apple’s eligibility decision.

A user who has previously used an introductory offer within the applicable subscription group may not be eligible for another trial.

If the user is not eligible, the App Store may offer the subscription at its normal price without a free-trial period.

A free trial is attached to an auto-renewable subscription.

Unless the user cancels within the period and manner indicated by Apple, the subscription converts to a paid subscription when the trial ends.

Apple then charges the payment method associated with the Apple Account at the price and for the billing period displayed when the subscription was confirmed, subject to Apple’s applicable rules.

Auto-renewable subscriptions continue renewing until cancelled.

Apple explains that introductory and free-trial subscriptions renew under the subscription terms presented to the subscriber.

Deleting TUREM from the device does not cancel a subscription.

Monthly and annual subscriptions renew automatically for successive billing periods unless cancelled through Apple.

The renewal date, renewal price and billing status are managed through the user’s Apple Account.

Apple may notify users of billing events, price changes or actions requiring consent in accordance with its policies and applicable law.

TUREM does not independently charge credit cards or other payment methods for App Store subscriptions.

Users may cancel an auto-renewable subscription through the subscription-management settings provided by Apple.

Cancellation normally prevents the next renewal.

Except where Apple or applicable law provides otherwise, cancellation does not immediately remove access already paid for. The subscription generally remains active until the end of the current billing period.

Deleting the application, deleting local projects or ceasing to use TUREM does not constitute cancellation.

Apple may allow users to change between subscription products offered within the applicable subscription group.

Depending on Apple’s subscription rules and the products involved:

• an upgrade may take effect immediately;
• a downgrade may take effect on the next renewal date;
• a change between equivalent levels or durations may follow Apple’s applicable timing rules;
• Apple may calculate any relevant billing adjustment.

The App Store’s confirmation interface and subscription-management screen prevail regarding when a change takes effect.

Apple provides subscription-group mechanisms through which users can change available service levels.

When a PRO or PRO+ subscription expires, is revoked or otherwise ceases to grant access, TUREM may return the account to the currently available FREE level.

As part of that transition:

• PRO or PRO+ functionality may become unavailable;
• subscription-included Sound Banks may become locked;
• editing or playback capabilities may be limited;
• content created with paid features may remain stored but become partially inaccessible;
• open audio playback may be stopped where required to enforce the active access level;
• TUREM may preserve a recovery snapshot or equivalent protected state;
• the application may return the user to a clean FREE-compatible Main state.

TUREM does not intend to delete Projects automatically merely because a subscription ends.

However, some Projects may require PRO or PRO+ to reopen, edit, reproduce or use all their original components.

Storage remains subject to the application’s technical operation, device storage, user actions and backup practices.

If the user later reactivates an eligible PRO or PRO+ subscription, TUREM should recognise the restored entitlement after Apple confirms it.

Previously stored Projects and eligible Sound Banks may become available again, subject to:

• continued local availability of project data;
• compatibility with the current application version;
• ownership of required Sound Banks;
• availability of third-party content;
• the active subscription level;
• the relevant Sound Bank licence.

Reactivation does not recover data that the user deleted, data removed from the device outside TUREM, or data unavailable because no backup exists.

TUREM may distribute Sound Banks free of charge.

A free Sound Bank may still be governed by:

• the TUREM Sound Bank License;
• technical compatibility requirements;
• an active TUREM account state;
• usage limits;
• specific notices displayed with the Sound Bank.

The fact that a Sound Bank is distributed free of charge does not place it in the public domain or transfer ownership of the underlying audio files.

TUREM may update, replace or discontinue the distribution of free Sound Banks, subject to applicable law.

An active PRO+ subscription may grant access to eligible Sound Banks included in the current PRO+ catalogue.

This is subscription-based access, not an individual purchase of every included Sound Bank.

Unless expressly indicated otherwise:

• access lasts only while the required PRO+ subscription remains active;
• the catalogue may evolve;
• Sound Banks may be added, updated, replaced or removed;
• access may be affected by territory, technical compatibility or licensing restrictions;
• expiry of PRO+ may lock the included Sound Banks.

Any lawful use of outputs created while access was active remains subject to the Sound Bank License and applicable third-party rights.

Certain special Sound Banks may be offered as separate in-app purchases.

Where a Sound Bank is sold as a one-time, non-consumable purchase, the purchase entitlement is associated with the user’s Apple Account according to Apple’s systems.

Purchasing a Sound Bank does not necessarily provide standalone access without a subscription.

A separately purchased Sound Bank may require an active compatible PRO or PRO+ subscription to be used inside TUREM.

The required subscription level must be disclosed before purchase.

The purchase interface should clearly communicate wording equivalent to:

Requires an active compatible PRO or PRO+ subscription to use.

By completing the purchase after that disclosure, the user acknowledges that:

• the individual purchase establishes ownership or entitlement to that Sound Bank within TUREM;
• the purchase does not replace the required subscription;
• access may be suspended when the compatible subscription ends;
• the Sound Bank purchase is not deleted or forfeited solely because the subscription ends;
• access should return when an eligible subscription is restored or reactivated.

For a separately purchased Sound Bank, TUREM distinguishes between:

Purchase ownership:

The Apple Account has a valid, recognised purchase entitlement for that Sound Bank.

Current usability:

The user also satisfies any active subscription, device, software-version and licence conditions required to use it.

A Sound Bank may therefore remain owned but temporarily locked.

Temporary locking because the required subscription is inactive does not itself cancel or erase the individual Sound Bank purchase.

Subscriptions and purchases grant limited access and usage rights. They do not transfer copyright or ownership of the source audio files.

All Sound Banks remain subject to the TUREM Sound Bank License and any specific licence displayed with a collection.

The Sound Bank License governs matters including:

• permitted use in TUREM;
• live performance;
• finished recordings or outputs;
• commercial exploitation;
• redistribution;
• extraction;
• resale;
• sample-pack creation;
• artificial-intelligence training;
• attribution;
• third-party or artist content.

Where a Sound Bank has specific terms, those specific terms may supplement or override the general Sound Bank License for that collection.

TUREM will provide a user-initiated Restore Purchases function for eligible App Store purchases.

Restore Purchases may be used when:

• reinstalling TUREM;
• moving to another compatible device;
• an active subscription is not recognised;
• a previously purchased Sound Bank is not recognised;
• restoring purchases associated with the same Apple Account.

Restore Purchases:

• does not create a new purchase;
• does not charge the user;
• does not duplicate a purchase;
• does not guarantee active subscription access when the subscription has expired;
• does not restore deleted local Projects or files;
• requires the Apple Account associated with the original transaction.

The application should ordinarily determine valid access automatically. Manual restoration is an additional user-initiated synchronisation mechanism rather than the sole method of recognising entitlements.

Apple describes proactive restoration and StoreKit mechanisms for recognising existing subscription and purchase access.

Publication condition: this section must not be presented as an available feature until Restore Purchases has been implemented and verified in the released application.

If Apple cannot renew a subscription because of a billing issue, Apple may attempt to recover the subscription.

Depending on Apple’s systems and TUREM’s configuration, the user may temporarily retain access during a billing grace period.

Access during billing retry or grace period is determined by the entitlement information supplied by Apple.

Apple provides billing-recovery mechanisms for auto-renewable subscriptions.

Requests for refunds concerning App Store purchases are generally handled through Apple’s processes.

TUREM does not directly control whether Apple approves or denies a refund.

If Apple refunds, revokes or reverses a transaction:

• the associated entitlement may be removed;
• paid features may become unavailable;
• a separately purchased Sound Bank may become locked;
• the application may update its local access state accordingly.

Nothing in these terms limits mandatory consumer rights.

A subscription or Sound Bank purchase is shareable through Apple Family Sharing only if:

• Apple permits that transaction type to be shared;
• TUREM has enabled the relevant option;
• the user’s Apple Account and family group satisfy Apple’s requirements.

No sharing entitlement should be assumed unless it is explicitly displayed by Apple or TUREM.

Subscriptions, introductory offers, Sound Banks, prices and features may vary by:

• country or region;
• Apple Account storefront;
• applicable taxes;
• local law;
• device;
• operating-system version;
• licensing restrictions;
• App Store availability.

A product offered in one territory may not be offered in another.

TUREM may develop, update, replace or discontinue features or content.

This may include changes to:

• FREE limits;
• PRO functionality;
• PRO+ functionality;
• Sound Bank catalogues;
• subscription benefits;
• technical requirements;
• compatibility;
• interface presentation.

Any changes will be subject to applicable law and Apple’s rules.

TUREM will not retroactively convert a valid individual purchase into no purchase. However, continued use may remain subject to the compatible subscription and technical requirements disclosed at the time of purchase.

TUREM may change subscription or in-app purchase prices through App Store Connect.

Apple determines how a price change is presented to existing and prospective subscribers and whether notice or consent is required.

The price shown by Apple before confirmation or renewal prevails.

No price stated on the TUREM website should be treated as overriding the final App Store price.

Paid access may depend on:

• a supported device;
• a supported operating-system version;
• a compatible version of TUREM;
• access to the App Store;
• internet connectivity for transaction validation or restoration;
• sufficient device storage;
• valid Apple transaction information.

TUREM is not responsible for the loss of access caused exclusively by an unsupported device or operating system where compatibility requirements were clearly disclosed.

A subscription or Sound Bank purchase provides access to specified application functionality or digital content.

It does not guarantee:

• a particular creative result;
• commercial success;
• legal clearance of third-party music;
• ownership of user-imported material;
• compatibility with every external workflow;
• continuous availability of third-party content.

Users remain responsible for ensuring they hold the necessary rights for music, recordings, performances and other content they import or use.

Nothing in these Subscription & Trial Terms excludes or limits rights that cannot legally be waived.

Users located in the European Union or other protected jurisdictions may have mandatory rights concerning digital services, conformity, remedies, transparency and unfair contract terms.

Apple’s role in processing a transaction does not remove mandatory rights against the party legally responsible under applicable law.

These terms may be updated to reflect:

• changes in subscription products;
• the introduction of new billing periods;
• changes to FREE, PRO or PRO+;
• new Sound Bank models;
• Apple policy changes;
• legal requirements;
• technical changes;
• improvements in clarity.

Material changes will apply prospectively and will be communicated where legally required.

The current version and effective date will be published in the TUREM Legal Center.

These Subscription & Trial Terms should be read together with:

• TUREM Terms of Use;
• TUREM Privacy Policy;
• TUREM Sound Bank License;
• TUREM Intellectual Property Notice;
• TUREM Support Policy;
• TUREM Legal Notice;
• Apple Standard EULA;
• Apple’s App Store purchase and subscription terms;
• any specific Sound Bank licence or disclosure.

In the event of a conflict:

1. mandatory applicable law prevails;
2. Apple’s transaction terms govern matters controlled by Apple;
3. specific Sound Bank terms govern the relevant Sound Bank;
4. these Subscription & Trial Terms govern TUREM subscription access;
5. the general Terms of Use apply to remaining matters.
