This Intellectual Property Notice explains the ownership and permitted use of intellectual property associated with TUREM.

It supplements the current:

  • TUREM End User License Agreement;
  • TUREM Sound Bank License;
  • TUREM Terms of Use; and
  • any specific licence accompanying a TUREM product, service or item of content.

Where a specific licence or agreement applies, that document governs the corresponding use.

1. Rights holder

Unless otherwise expressly stated, the intellectual property associated with TUREM is owned or lawfully controlled by:

Except where expressly stated otherwise, all original content, software, recordings, documentation and creative materials associated with TUREM are protected by applicable copyright, neighbouring-rights, database-rights and other intellectual-property laws and treaties.

Copyright protection applies automatically to qualifying original works from the moment they are created or fixed in a protectable form. Registration, deposit or publication is not generally required for copyright to arise, although registration or other reliable evidence may assist in proving authorship, ownership and date of creation.

3. Protected TUREM materials

Protected TUREM materials may include, without limitation:

  1. the TUREM software application;
  2. source code and object code;
  3. software architecture, organisation and original technical implementation;
  4. original user-interface artwork and visual expression;
  5. application screens, graphics, icons, animations and illustrations;
  6. the TUREM name, logos, application icon, slogans and brand identity;
  7. Official Sound Banks and Sound Bank Collections;
  8. original sound recordings, samples, loops, layers and audio assets;
  9. presets, parameter configurations and proprietary mappings;
  10. original databases, classifications and metadata structures;
  11. documentation, specifications, manuals and tutorials;
  12. website text, artwork and audiovisual content;
  13. promotional and marketing materials;
  14. photographs, videos and demonstrations created by or for TUREM;
  15. original names and artwork associated with Sound Banks;
  16. updates, adaptations, translations and authorised derivative works; and
  17. other original content created by or on behalf of Mario Zanetti or TUREM.

The inclusion of an item in this list does not mean that TUREM claims exclusive rights over ideas, facts, abstract concepts, generic musical techniques, standard software functionality or other material that the law does not protect.

4. Software protection

TUREM software is protected as a computer program under applicable intellectual-property law.

Protection may extend to original source code, object code, preparatory design material, documentation and other protectable expression embodied in the software.

No licence to access or use TUREM authorises access to its source code or grants ownership of the software.

Use of the application is governed by the TUREM End User License Agreement.

5. Sound Banks and audio materials

Official TUREM Sound Banks and their constituent recordings, samples, layers, loops, presets, artwork, metadata and configurations are licensed, not sold.

Their availability through:

  • a Free Version;
  • a trial;
  • a PRO subscription;
  • an individual purchase;
  • a promotional offer; or
  • another authorised entitlement

does not place them in the public domain and does not transfer ownership to the user.

Use of these materials is governed by the TUREM Sound Bank License and any additional terms accompanying a specific Sound Bank.

6. User-created content

TUREM does not claim ownership of original content lawfully created or imported by a user merely because it is processed or organised through the application.

Users retain the rights they lawfully hold in their original contributions.

However, using TUREM does not transfer to the user any rights in:

  1. TUREM software;
  2. Official Sound Banks;
  3. protected samples or recordings;
  4. TUREM branding;
  5. proprietary structures or metadata;
  6. third-party music or recordings; or
  7. any other material that the user does not own or have permission to use.

7. No ownership through access or modification

Downloading, subscribing to, purchasing, accessing, processing or modifying protected TUREM materials does not transfer ownership.

In particular, ownership is not acquired by:

  1. renaming an asset;
  2. converting its format;
  3. changing volume, pitch, speed or equalisation;
  4. adding effects;
  5. looping or layering it;
  6. resampling it;
  7. recording its playback;
  8. combining it with limited additional material; or
  9. applying an automated transformation.

Any permitted use remains subject to the applicable licence.

8. Reserved rights

Unless TUREM gives prior written permission or an applicable licence expressly permits the activity, you may not:

  1. reproduce or distribute protected TUREM materials;
  2. copy or imitate protected visual, audio or textual expression;
  3. extract assets from the application;
  4. publish or redistribute source files;
  5. sell, sublicense, rent, lend or transfer protected materials;
  6. create unauthorised derivative versions of the software;
  7. remove copyright, attribution or rights-management information;
  8. use TUREM materials to create a competing sound library, application or service;
  9. use protected audio assets to train or supply machine-learning systems;
  10. register protected TUREM content as your own;
  11. claim exclusive rights over shared licensed Sound Bank assets;
  12. use TUREM branding in a misleading manner; or
  13. assist another person in carrying out an unauthorised act.

These restrictions apply subject to any exception or limitation that mandatory law expressly permits.

9. Trademarks and brand identifiers

TUREM, its logos, application icon, visual identity, slogans, product names, Sound Bank collection names and related brand identifiers are trademarks, trade names or distinctive signs owned or claimed by Mario Zanetti, except where another owner is expressly identified.

The presence of the symbols ™ or ® is not required for every intellectual-property or trademark right to exist.

However, the symbol ® must only be used for a trademark in territories and classes where the mark has actually been registered.

Until registration is completed, the following form may be used where appropriate:

TUREM™ A European Union trademark right is obtained through registration with EUIPO; an application or commercial use alone should not be represented as a completed EU registration.

10. Permitted reference to TUREM

A user, journalist, reviewer, educator or creator may make a limited, truthful and non-misleading reference to TUREM for purposes such as:

  1. identifying the application used;
  2. describing compatibility;
  3. reviewing or discussing the application;
  4. providing legitimate instruction or commentary; or
  5. crediting TUREM voluntarily.

Any reference must not:

  1. imply endorsement, sponsorship or partnership;
  2. suggest that the user owns the TUREM brand;
  3. use TUREM as the principal brand of another product;
  4. create confusion about commercial origin; or
  5. falsely describe unofficial material as an official TUREM product.

11. Logos, screenshots and promotional materials

TUREM logos, application icons and official artwork may not be altered, redrawn, animated, recoloured or incorporated into another brand without prior written permission.

Screenshots or short screen recordings may be used for legitimate:

  • reviews;
  • journalism;
  • tutorials;
  • commentary;
  • education; or
  • promotion of a lawful work created using TUREM,

provided that the use:

  1. is truthful and non-misleading;
  2. does not disclose confidential or pre-release information;
  3. does not expose protected Sound Bank source files;
  4. does not facilitate extraction or copying;
  5. does not falsely imply TUREM endorsement; and
  6. complies with applicable law and the EULA.

12. Third-party materials

TUREM may include or interact with materials owned by third parties.

Third-party:

  • software;
  • trademarks;
  • music;
  • recordings;
  • fonts;
  • frameworks;
  • libraries;
  • services; and
  • other content

remain the property of their respective owners and are governed by their applicable licences and terms.

Reference to a third-party name or product does not necessarily imply sponsorship, endorsement or affiliation.

Open-source components are governed by their respective open-source licences.

13. Unauthorised copying and imitation

TUREM reserves the right to act against unauthorised:

  1. copying of software or protected content;
  2. extraction or redistribution of Sound Banks;
  3. substantial reproduction of original visual expression;
  4. misuse of branding;
  5. publication of confidential source material;
  6. circumvention of access or entitlement controls;
  7. false claims of authorship or ownership;
  8. distribution of counterfeit or modified versions; and
  9. other infringements of intellectual-property or contractual rights.

The fact that another product changes individual colours, labels, dimensions or minor interface elements does not by itself determine whether protected expression has or has not been infringed. Any assessment depends on the protected material, the degree and nature of copying, applicable law and the facts of the particular case.

14. Reporting suspected infringement

Suspected infringement of TUREM intellectual property should be reported to:

legal@turem.app A report should, where reasonably possible, include:

  1. the reporter’s full name and contact information;
  2. identification of the protected TUREM material;
  3. identification and location of the allegedly infringing material;
  4. a description of the suspected infringement;
  5. screenshots, recordings or other supporting evidence;
  6. relevant dates;
  7. information about the platform, seller or distributor involved; and
  8. a statement confirming that the report is made in good faith.

TUREM may request further information before taking action.

15. Third-party infringement complaints

A person who believes that material made available by TUREM infringes their intellectual-property rights may contact:

legal@turem.app The notice should include:

  1. identification of the claimant or authorised representative;
  2. identification of the right allegedly infringed;
  3. evidence of ownership or authority where appropriate;
  4. identification of the disputed material;
  5. a clear explanation of the claim;
  6. contact information; and
  7. a good-faith statement that the information supplied is accurate.

TUREM may investigate the complaint, request clarification, restrict disputed material or take other appropriate action without admitting liability.

16. Enforcement

Where appropriate, TUREM may use legally available measures including:

  1. preservation of evidence;
  2. platform infringement reports;
  3. removal or takedown requests;
  4. cease-and-desist communications;
  5. suspension or termination of access;
  6. opposition or cancellation proceedings relating to conflicting trademarks;
  7. civil claims;
  8. requests for injunctive relief;
  9. claims for damages or recoverable profits; and
  10. other remedies available under applicable law.

Nothing in this Notice guarantees that TUREM will pursue every report or alleged infringement.

17. Permissions and licensing requests

Requests to use TUREM intellectual property outside the scope of an existing licence must be sent to:

legal@turem.app The request should explain:

  1. the material requested;
  2. the intended use;
  3. the territory;
  4. the duration;
  5. the distribution method;
  6. whether the use is commercial;
  7. the intended audience; and
  8. any proposed modifications.

No permission is granted unless confirmed expressly in writing by an authorised representative of TUREM.

Silence, lack of objection or previous informal tolerance does not constitute permission.

18. No waiver

Failure to identify an item with a copyright, trademark or other proprietary notice does not waive any applicable right.

Failure to enforce a right immediately does not waive the right to enforce it later.

19. Changes to this Notice

TUREM may update this Notice to reflect:

  1. new products or services;
  2. new Sound Banks or collections;
  3. trademark registrations;
  4. changes in ownership;
  5. legal or regulatory developments;
  6. additional distribution channels; or
  7. clarification of existing protections.

The current version will be made available through the TUREM website or application.

20. Governing framework

This Notice must be read consistently with:

  • applicable mandatory law;
  • the TUREM End User License Agreement;
  • the TUREM Sound Bank License;
  • the TUREM Terms of Use;
  • applicable Privacy Policy provisions;
  • specific purchase or content licences; and
  • applicable third-party and open-source licences.

This Notice is informational and does not expand TUREM’s exclusive rights beyond those recognised by applicable law.
