This TUREM Sound Bank License (“Sound Bank License” or “License”) governs your access to and use of official sound banks, sound collections and related audio materials made available by or on behalf of TUREM.
This License forms part of, and must be read together with, the current TUREM End User License Agreement (“EULA”).
The Licensor is:
Mario Zanetti Calle Arcediano Andreu 9 46500 Sagunto, Spain Legal enquiries: legal@turem.app Technical support: support@turem.app Website: https://turem.app
By downloading, installing, accessing, purchasing, subscribing to, loading or using a TUREM Sound Bank, you acknowledge that you have read and understood this License and agree to be bound by it.
If you do not agree to this License, you must not access or use the relevant Sound Bank.
Nothing in this License excludes or limits any statutory right that cannot lawfully be excluded or limited.
1. DEFINITIONS
1.1 “App”
“App” means the TUREM software application and any authorised version, update or successor application through which a Sound Bank is made available.
1.2 “Authorised User”
“Authorised User” means an End User who lawfully accesses the relevant Sound Bank through the App under the Free Version, a valid trial, an active PRO entitlement, an individual purchase or another entitlement authorised by TUREM.
1.3 “Constituent Asset”
“Constituent Asset” means any individual sound, sample, loop, recording, layer, stem, preset, configuration, metadata record, parameter mapping, artwork, name or other component included in a Sound Bank.
1.4 “Finished Output”
“Finished Output” means a genuine musical, audiovisual, artistic or other creative production in which one or more Constituent Assets have been lawfully incorporated as part of a broader creative work.
A Finished Output does not include a Sound Bank, sample pack, loop pack, isolated recording, stock-audio collection, preset collection or other product whose principal purpose is to redistribute or expose the Constituent Assets.
1.5 “Official FREE Sound Bank”
“Official FREE Sound Bank” means a protected Sound Bank identified by TUREM as available for use under the Free Version.
1.6 “Official PRO Sound Bank”
“Official PRO Sound Bank” means a Sound Bank made available under a valid PRO entitlement.
“Premium Sound Bank” means a Sound Bank, collection or content pack supplied under a separate purchase, promotional entitlement, artist licence or other specific commercial arrangement.
1.8 “Project”
“Project” has the meaning given in the EULA and includes a session, snapshot, configuration, arrangement or state stored or interpreted by the App.
1.9 “Protected Sound Bank Materials”
“Protected Sound Bank Materials” means each official Sound Bank and all Constituent Assets, recordings, arrangements, classifications, structures, presets, names, artwork, metadata and other proprietary material embodied in or supplied with it.
1.10 “Sound Bank”
“Sound Bank” means a collection of sounds, recordings, samples, loops, layers, presets, configurations or related materials organised for use within TUREM.
1.11 “User Content”
“User Content” has the meaning given in the EULA and includes material imported, recorded, created or supplied by the End User, excluding Protected Sound Bank Materials.
1.12 “User Sound Bank”
“User Sound Bank” means a Sound Bank created by an End User from User Content using functions lawfully made available by the App.
2. RELATIONSHIP WITH THE EULA
2.1 Supplemental licence
This Sound Bank License supplements the EULA and governs Protected Sound Bank Materials specifically.
2.2 Continued application of the EULA
All applicable provisions of the EULA continue to apply, including those relating to:
- intellectual property;
- User Content;
- Outputs;
- subscriptions and entitlements;
- restrictions;
- reverse engineering;
- termination;
- liability;
- Apple Services; and
- governing law.
2.3 Order of precedence
If this License conflicts with the EULA concerning the use of a Sound Bank, this License governs solely with respect to that Sound Bank.
Mandatory law and applicable Apple transaction terms remain unaffected.
2.4 Specific Sound Bank terms
A particular Sound Bank may include additional licence terms.
Where clearly presented before or at the time of access or purchase, those specific terms govern that Sound Bank to the extent they differ from this general License.
3. OWNERSHIP
3.1 Ownership retained
Protected Sound Bank Materials remain owned by Mario Zanetti, TUREM or the relevant third-party rights holder.
3.2 Licence, not sale
Sound Banks and Constituent Assets are licensed, not sold.
Access, download, installation, subscription or purchase does not transfer ownership of any Protected Sound Bank Material.
3.3 No ownership through modification
Processing, mixing, renaming, pitching, filtering, looping, layering, fading, transforming, resampling, recording or otherwise modifying a Constituent Asset does not transfer ownership of the underlying asset.
3.4 Reservation of rights
All rights not expressly granted under this License are reserved.
No licence arises by implication, estoppel, course of dealing or other inference.
4. LICENCE GRANT
4.1 Limited licence
Subject to your compliance with this License, TUREM grants you a limited, personal, non-exclusive, revocable, non-sublicensable and non-transferable licence to use the relevant Sound Bank through the App for the duration and scope of your valid entitlement.
4.2 Authorised purposes
You may use a Sound Bank for lawful:
- personal creative use;
- professional creative use;
- educational activity;
- artistic development;
- live performance;
- client sessions;
- facilitation or wellness sessions;
- musical composition;
- audiovisual production;
- sound design; and
- other creative activity permitted by this License.
4.3 Commercial activity
You may charge for a service, session, performance, production or Finished Output that lawfully uses a Sound Bank, provided that:
- you are an Authorised User;
- your entitlement permits the relevant use;
- the Sound Bank is used through an authorised version of TUREM;
- the use forms part of a genuine service, performance or creative production;
- no Constituent Asset is redistributed in isolated or substantially reusable form; and
- all third-party music and content rights have been obtained.
4.4 No promise of recording or export functionality
This License does not represent or guarantee that TUREM currently provides recording, rendering, export, sharing or publication functionality.
Any such function may be available only in particular versions, tiers or future releases.
4.5 Technical capability does not determine legal permission
The fact that the App technically permits a sound, session or Project to be played, processed, imported, recorded or exported does not by itself establish that the End User has the legal right to exploit all material involved.
5. LIVE PERFORMANCES AND PROFESSIONAL SESSIONS
5.1 Live performance
An Authorised User may use a Sound Bank as part of a live performance, facilitated sound session, meditation, workshop, class, artistic event or comparable professional activity.
5.2 Charging clients
The Authorised User may charge participants, clients, venues or organisers for the performance or service.
No separate royalty is owed to TUREM solely because the authorised Sound Bank is used as part of that service, unless a specific Sound Bank licence expressly states otherwise.
5.3 Third-party rights
This permission covers only TUREM’s rights in the relevant Protected Sound Bank Materials.
It does not grant rights in third-party songs, recordings, compositions, performances, samples or audiovisual works used during the same session.
5.4 Public-performance obligations
The Authorised User remains responsible for any licence, royalty, reporting or authorisation required by a collecting society, venue, publisher, record label, performer or other rights holder.
5.5 No redistribution through performance
A performance must not be structured primarily to provide participants with access to clean, isolated or recoverable copies of Constituent Assets.
6. FINISHED OUTPUTS
6.1 Conditional permission
Where TUREM lawfully provides or permits the relevant recording, rendering or export function, an Authorised User may create and exploit a Finished Output incorporating Protected Sound Bank Materials.
6.2 Rights required
Commercial or public exploitation is permitted only where the Authorised User owns or has obtained all necessary rights, licences, permissions and consents for:
- musical compositions;
- sound recordings;
- performances;
- samples;
- audiovisual material;
- photographs and artwork;
- spoken-word material;
- client or participant contributions; and
- any other third-party content included in the Finished Output.
6.3 Permitted forms of exploitation
Subject to this License, a lawful Finished Output may be:
- performed publicly;
- supplied to a client;
- incorporated into a film or video;
- used in a meditation or guided practice;
- included in a podcast;
- streamed;
- broadcast;
- uploaded to an online platform;
- included in a course;
- synchronised with visual material;
- monetised;
- sold or licensed; or
- distributed through music or audiovisual platforms.
6.4 No automatic clearance
TUREM does not clear, verify or license third-party material merely because it can be imported or used within the App.
6.5 No guarantee of platform acceptance
TUREM does not guarantee that a Finished Output will be accepted by a streaming platform, distributor, broadcaster, content-identification system, collecting society or marketplace.
6.6 Non-exclusive underlying assets
Other Authorised Users may lawfully use the same Sound Bank or Constituent Assets.
You must not claim exclusive ownership over a Constituent Asset or seek to prevent lawful use of the same asset by another Authorised User.
7. FINISHED-OUTPUT REQUIREMENT
7.1 Genuine creative integration
A Finished Output must contain genuine creative, musical, production, performance or arrangement choices beyond the mere reproduction of a Constituent Asset.
7.2 Factors indicating genuine integration
Relevant factors may include:
- the combination of multiple sounds or elements;
- original performance;
- original composition;
- meaningful arrangement;
- layering;
- editing;
- transformation;
- audiovisual integration;
- narration or spoken content;
- structural development; or
- another substantive creative contribution.
7.3 Insufficient modification
The following alone will not ordinarily convert a Constituent Asset into a freely redistributable Finished Output:
- changing its filename;
- changing its file format;
- minor equalisation;
- small volume changes;
- trivial reverb or delay;
- minimal pitch or speed adjustment;
- adding silence;
- placing the asset inside another container;
- looping it without substantive creative development; or
- applying processing that can readily be reversed.
7.4 Sparse and prominent use
A Constituent Asset may be audible, prominent or sparsely arranged within a genuine Finished Output.
Prominence alone does not violate this License where the overall result is a legitimate creative work and does not function as a substitute for the original Sound Bank asset.
8. PROHIBITED REDISTRIBUTION
You must not, directly or indirectly:
- distribute a Sound Bank in whole or in part;
- share a Constituent Asset with another person;
- upload a Constituent Asset to cloud storage for access by unauthorised users;
- publish a Constituent Asset through a website, repository, forum, social network or file-sharing service;
- sell, rent, lease, lend, sublicense or give away a Sound Bank;
- supply a Sound Bank to a client, collaborator, student or participant;
- include a Constituent Asset in a downloadable project where the asset can be extracted;
- include Protected Sound Bank Materials in a template intended for redistribution;
- permit another person to copy or recover a Constituent Asset from your Device;
- make a Sound Bank available through peer-to-peer sharing; or
- facilitate any prohibited redistribution by another person.
9. PROHIBITED EXTRACTION AND CAPTURE
You must not:
- extract a Sound Bank from the App bundle;
- access internal application storage to recover Protected Sound Bank Materials;
- intercept internal audio, file or memory processes for extraction;
- decrypt, decode or bypass protection applied to a Sound Bank;
- capture isolated Constituent Assets for reuse outside the authorised workflow;
- reconstruct a Sound Bank from rendered or recorded output;
- use automated tools to identify and separate individual Constituent Assets;
- exploit a vulnerability or unauthorised Device modification to obtain protected files; or
- instruct, assist or commission another person to perform any such act.
This section does not prohibit an act that mandatory law expressly permits notwithstanding contractual restriction.
10. COMPETING AND REDISTRIBUTABLE PRODUCTS
Protected Sound Bank Materials must not be used to create or supply:
- another Sound Bank;
- a sample pack;
- a loop pack;
- a stem collection;
- a preset library;
- a sound-effects library;
- a production-music library;
- stock audio;
- a virtual instrument;
- a synthesiser preset pack;
- a plugin;
- a software application;
- a web service;
- a content-generation service;
- an audio marketplace product;
- a subscription audio library;
- an embedded-hardware sound collection; or
- another product that replaces, competes with or redistributes the Sound Bank.
This restriction applies even where a Constituent Asset has been subjected to nominal, automated or technically reversible processing.
11. ARTIFICIAL INTELLIGENCE AND MACHINE LEARNING
Unless TUREM provides prior written permission, you must not use Protected Sound Bank Materials:
- to train a machine-learning model;
- to fine-tune a model;
- as model-conditioning data;
- as a reference dataset;
- as an evaluation or benchmark dataset;
- to create embeddings;
- for source-separation research intended to recover the assets;
- to create a generative sound or music model;
- to populate a retrieval database for generative systems;
- to provide prompts, examples or target outputs to an automated generation service where the assets are copied or uploaded; or
- to create synthetic substitutes intended to reproduce the distinctive content of a Sound Bank.
This restriction does not prohibit ordinary device-level processing that is necessary for TUREM to operate and that does not expose or repurpose Protected Sound Bank Materials as training data.
12. NFTS, TOKENS AND DIGITAL ASSETS
You must not use a Sound Bank or Constituent Asset as the principal subject, underlying asset or source of value of:
- a non-fungible token;
- a transferable digital token;
- a blockchain-based collectible;
- a fractional ownership product; or
- another digital asset representing ownership of the protected sound.
A Finished Output may be associated with a digital token only where:
- the Finished Output complies fully with this License;
- the token does not grant access to or ownership of a Constituent Asset;
- the underlying protected sound cannot be extracted or redistributed; and
- the token description does not misrepresent ownership of TUREM materials.
13. CLIENT WORK AND COLLABORATION
13.1 Client productions
An Authorised User may create a Finished Output for a client and may transfer or license the End User’s rights in that Finished Output.
13.2 Underlying licence not transferred
The client does not acquire ownership of, or a standalone licence to, any Protected Sound Bank Material.
13.3 Deliverables
You may deliver:
- a finished stereo or multichannel recording;
- a completed audiovisual production;
- a finished rendered composition;
- an exported file that does not expose Protected Sound Bank Materials; or
- another non-extractable final deliverable.
13.4 Project files
You may provide an editable Project only where:
- TUREM permits Project sharing;
- the recipient is an Authorised User;
- the recipient holds the necessary entitlement to the relevant Sound Bank;
- no protected internal asset is embedded in extractable form; and
- all third-party User Content may lawfully be shared.
13.5 Collaborators
Each collaborator who directly accesses or uses a Sound Bank must hold their own lawful access or entitlement unless Apple’s authorised sharing rules or a specific TUREM licence expressly provide otherwise.
14. EDUCATIONAL USE
14.1 Teaching and demonstration
An Authorised User may demonstrate a Sound Bank during a class, workshop or educational activity.
14.2 No distribution to students
Students or participants may not be given copies of Constituent Assets unless each recipient is independently authorised.
14.3 Course materials
A Finished Output may be included in a commercial or free course, provided that:
- it meets the Finished Output requirements;
- the protected assets cannot be extracted;
- access to the course does not operate as a substitute for obtaining the Sound Bank; and
- all other rights have been cleared.
14.4 Tutorials
Screenshots, short screen recordings or demonstrations of the App may be used for legitimate commentary, teaching, review or support, subject to applicable law and the EULA.
Such materials must not expose protected audio files or facilitate their reconstruction.
15. OFFICIAL FREE SOUND BANKS
15.1 Access
An Official FREE Sound Bank may be used while it remains available under the Free Version.
15.2 Protected status
Official FREE Sound Banks remain protected, non-editable official content.
Free availability does not place the Sound Bank or its Constituent Assets in the public domain and does not create an unrestricted licence.
15.3 Session controls
The App may allow temporary session-level changes such as:
- volume;
- pan;
- mute;
- solo;
- reverb; and
- reset.
Such changes do not modify ownership or create a new Sound Bank.
15.4 Non-persistence
Temporary settings may reset when the Sound Bank is unloaded, reopened or updated, consistently with the App’s current functionality.
15.5 Withdrawal or replacement
TUREM may replace, update or withdraw an Official FREE Sound Bank, subject to applicable law and any relevant contractual commitment.
16. OFFICIAL PRO SOUND BANKS
16.1 Subscription access
An Official PRO Sound Bank may be accessed only while the relevant PRO entitlement remains valid, unless separate terms provide permanent access.
16.2 End of entitlement
When PRO access ends:
- the Sound Bank may become unavailable or locked;
- Projects referring to it may become inaccessible or incomplete;
- access may be restored if the relevant entitlement is reactivated; and
- no ownership right arises from previous subscription access.
16.3 Existing Finished Outputs
Loss of PRO access does not by itself revoke the Authorised User’s right to continue exploiting a Finished Output lawfully created while the entitlement was valid.
This continued permission applies only to the Finished Output and does not permit further access to, extraction of or reuse of the underlying Sound Bank after entitlement expiry.
16.4 Future official content
TUREM may decide that future Official PRO Sound Banks are:
- included within PRO;
- offered as Premium Sound Banks;
- licensed for a limited period;
- sold separately; or
- governed by artist-specific terms.
The applicable offer will identify the relevant access model.
17.1 Additional terms
Premium Sound Banks and artist-created Sound Banks may include additional restrictions, credits, territorial conditions or royalty provisions.
17.2 Presentation before purchase
Material licence conditions specific to a Premium Sound Bank should be presented before or at the time of purchase or access.
17.3 Third-party licensors
Where a Sound Bank is supplied under licence from an artist or third party:
- that party retains its applicable rights;
- TUREM may enforce the licence on its own behalf or on behalf of the relevant rights holder;
- required attribution must be preserved; and
- the relevant third party may be an intended beneficiary of the specific Sound Bank terms where expressly stated.
17.4 No assumption of inclusion
A PRO subscription does not automatically include every future Premium Sound Bank unless the applicable offer expressly says so.
18. USER SOUND BANKS
18.1 User ownership
TUREM does not claim ownership of original User Content lawfully used to create a User Sound Bank.
18.2 Responsibility for rights
The End User is solely responsible for ensuring that they possess all rights necessary to:
- import the source material;
- assemble the User Sound Bank;
- use it professionally;
- share it;
- export it; and
- create or distribute Outputs from it.
18.3 No legal approval
The App’s technical ability to create a User Sound Bank does not constitute approval, clearance or confirmation of rights.
18.4 TUREM structures
A User Sound Bank may contain proprietary TUREM structures, identifiers, metadata formats or parameter systems.
The End User’s ownership of User Content does not transfer ownership of those proprietary technical elements.
18.5 Downgrade
Where the App’s current access model applies:
- User Sound Banks created under PRO may remain stored after downgrade;
- they may remain visible but locked;
- they may be inaccessible until PRO is restored;
- they may be deleted by the End User where the App permits; and
- downgrade does not transfer ownership of or delete the User Content solely because PRO has ended.
19. PROJECTS CONTAINING SOUND BANKS
19.1 References and dependencies
A Project may refer to one or more Sound Banks without transferring or embedding a distributable licence to those banks.
19.2 Recipient entitlement
A person receiving a Project must independently hold any entitlement required to access the referenced Sound Bank.
TUREM does not guarantee that a Project will remain fully reproducible where:
- a Sound Bank has been withdrawn;
- the entitlement has expired;
- the Sound Bank version has changed;
- the recipient lacks the required access;
- files are missing; or
- technical compatibility has changed.
19.4 Project sharing does not license assets
Sharing a Project does not authorise sharing or redistributing its referenced Protected Sound Bank Materials.
20. CONTENT IDENTIFICATION AND COPYRIGHT CLAIMS
Because multiple users may lawfully use the same Constituent Assets, Finished Outputs may contain similar or identical underlying sounds.
You must not knowingly register, claim or enforce exclusive ownership over a Constituent Asset itself.
20.3 Automated identification systems
Where you submit a Finished Output to an automated content-identification or rights-management system, you must configure and manage the claim so that it does not improperly block other lawful users of the same Sound Bank.
20.4 Responsibility for claims
You are responsible for resolving any claim arising from:
- third-party content used by you;
- false exclusivity assertions;
- improper content-identification registration; or
- failure to comply with a platform’s rules.
20.5 TUREM cooperation
TUREM may provide reasonable information confirming that a Sound Bank is non-exclusive, but does not guarantee resolution of a platform dispute.
21. ATTRIBUTION
21.1 General rule
Unless a specific Sound Bank licence expressly requires attribution, you are not required to credit TUREM solely because a licensed Sound Bank is incorporated into a lawful Finished Output.
21.2 Optional credit
Where appropriate, you may use a truthful credit such as:
Created using TUREM.
or:
Includes licensed sounds from TUREM.
21.3 No endorsement implication
Any credit must not suggest that TUREM endorses, sponsors or approves the Finished Output unless written permission has been granted.
21.4 Required artist credit
If a specific artist or Premium Sound Bank requires attribution, the stated credit format must be followed.
22. TRADEMARKS AND BRANDING
22.1 No trademark licence
This License does not grant a general right to use:
- the name TUREM;
- the TUREM logo;
- the application icon;
- Sound Bank artwork;
- product names;
- slogans; or
- other brand identifiers.
22.2 Truthful reference
You may make a limited, truthful and non-misleading reference to TUREM to describe the tool used to create a Finished Output.
22.3 Prohibited branding use
You must not:
- brand your own Sound Bank as official TUREM content;
- use a confusingly similar name or logo;
- register a domain or account incorporating TUREM in a misleading manner;
- imply official partnership or certification; or
- use TUREM branding as the principal branding of your product.
23. BACKUPS AND STORAGE
23.1 User responsibility
You are responsible for maintaining appropriate backups of User Content, Projects and Finished Outputs.
23.2 No extraction for backup
The need for a backup does not authorise extraction of Protected Sound Bank Materials from the App.
23.3 App restoration
Restoration of the App, entitlement or purchase may depend on Apple Services, internet access, compatibility and continued availability of the relevant Sound Bank.
23.4 No permanent-availability guarantee
Except where applicable law or specific purchase terms require otherwise, TUREM does not guarantee that every Sound Bank will remain available indefinitely.
24. UPDATES AND VERSION CHANGES
24.1 Updates
TUREM may update a Sound Bank to:
- correct defects;
- improve quality;
- adjust metadata;
- add compatibility;
- address legal or security concerns;
- replace content; or
- improve the user experience.
24.2 Version differences
An updated Sound Bank may sound or behave differently from an earlier version.
24.3 Project impact
TUREM may provide version references or compatibility warnings, but does not guarantee exact reproduction of every historical Project across all future versions.
24.4 Mandatory consumer rights
Nothing in this section removes any update, conformity or remedy right required by applicable consumer law. Digital-content contracts in the European Union remain subject to mandatory conformity and consumer-remedy rules.
25. SUSPENSION AND TERMINATION
25.1 Term
This License begins when you first access or use the Sound Bank and continues until terminated.
25.2 Automatic end of access
Your right to access a Sound Bank may end when:
- the applicable Subscription expires;
- a trial ends;
- a purchase is refunded or revoked;
- the entitlement is cancelled or withdrawn;
- the App is no longer authorised on the Device; or
- another applicable licence condition ends.
25.3 Termination for breach
TUREM may suspend or terminate this License where you:
- redistribute Protected Sound Bank Materials;
- extract Constituent Assets;
- circumvent entitlement protection;
- infringe intellectual-property rights;
- misuse TUREM branding;
- use the assets for prohibited machine-learning purposes; or
- materially or repeatedly breach this License.
25.4 Consequences
After termination:
- you must stop accessing and using the affected Sound Bank;
- you must delete any unauthorised copies;
- protected Projects may become inaccessible;
- no further Finished Outputs may be created using the affected bank; and
- provisions intended to survive remain effective.
25.5 Existing lawful Finished Outputs
Unless termination results from unlawful creation or infringement, termination does not normally require withdrawal of a Finished Output lawfully completed and distributed before termination.
This does not permit continued use of the underlying Sound Bank after access has ended.
26. ENFORCEMENT AND REMEDIES
26.1 Intellectual-property enforcement
Unauthorised extraction, copying or distribution may infringe copyright, contractual rights and other applicable legal protections.
26.2 Available remedies
TUREM may seek any remedy available under applicable law, including:
- suspension of access;
- termination;
- removal requests;
- injunctive relief;
- recovery of damages;
- recovery of profits where permitted;
- preservation of evidence; and
- reasonable legal costs where recoverable.
26.3 No waiver
Failure to enforce a provision immediately does not waive the right to enforce it later.
27. WARRANTIES AND LIABILITY
27.1 Mandatory rights
Nothing in this License excludes or limits liability, warranties or consumer remedies that cannot lawfully be excluded or limited.
27.2 Sound Bank availability
To the maximum extent permitted by law, TUREM does not warrant that every Sound Bank will:
- meet every artistic expectation;
- remain available indefinitely;
- be compatible with every future Device or App version;
- be free from every defect;
- produce a particular commercial result; or
- avoid similarity with another user’s lawful production.
27.3 Third-party rights
TUREM is not responsible for third-party content imported or combined with a Sound Bank by the End User.
27.4 Platform claims
TUREM is not responsible for an online platform’s independent decision to reject, demonetise, flag or remove a Finished Output, except where responsibility cannot lawfully be excluded.
27.5 EULA liability provisions
The warranties, exclusions and limitations in the EULA apply to this License to the fullest extent permitted by law.
28. CHANGES TO THIS LICENSE
28.1 Updates
TUREM may update this License to reflect:
- new Sound Bank models;
- changes to the App;
- artist or third-party licences;
- legal developments;
- new distribution channels;
- security requirements; or
- clarification of existing provisions.
28.2 Notice
Where a change materially affects existing rights and applicable law requires notice or consent, TUREM will provide the required notice or obtain the required consent.
28.3 Existing Finished Outputs
A later version of this License will not retroactively make a previously lawful Finished Output unlawful, except where required by law or where the original use was based on fraud, infringement or material breach.
28.4 Specific purchase terms
Rights granted permanently under a specific completed purchase will not be removed contrary to the applicable purchase terms or mandatory law.
29. GOVERNING LAW AND DISPUTES
29.1 Governing law
Subject to mandatory consumer protections, this License is governed by the laws of Spain.
29.2 Consumers
Consumers retain the protection of mandatory laws and forums available in their country of habitual residence.
29.3 Professional users
Where the user acts primarily for business or professional purposes and no mandatory rule provides otherwise, the courts of Valencia, Spain, will have exclusive jurisdiction.
29.4 Informal contact
Before commencing formal proceedings, the parties are encouraged to contact:
legal@turem.app This does not limit urgent remedies or mandatory rights.
30. GENERAL PROVISIONS
30.1 Severability
If a provision is invalid or unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions will continue in effect.
30.2 No waiver
A waiver is effective only when made expressly and in writing.
30.3 Assignment
You may not assign or transfer this License except where applicable law or an authorised Apple mechanism permits.
TUREM may transfer this License as part of a transfer of the TUREM business, subject to applicable consumer and data-protection law.
30.4 Entire agreement
This License, the EULA and any applicable specific Sound Bank terms constitute the agreement governing the relevant Sound Bank.
30.5 Language
The English version is the principal international version, subject to any mandatory local-language and consumer-law requirements.
